Terms & conditions
MyCards is a free app published by José Rojas Jimenez. These terms govern the app and this website. Read them before using MyCards; mandatory rights remain unaffected.
1. Licence grant
Subject to these terms, the publisher grants you a free, limited, non-exclusive, non-transferable licence to install and use MyCards on devices you own or control for lawful personal use. This is a licence to use the app, not a transfer of ownership of its software, brand or other intellectual property.
You may not sell or sublicense the app, distribute altered copies, or remove ownership notices, except where applicable law or the licences of included open-source components permit it. Third-party components and retailer marks remain subject to their respective rights and licences. The licence may end under section 5, subject to mandatory rights.
Only add cards and barcodes you are authorised to use. Do not impersonate another person, misuse loyalty programmes, obtain unauthorised benefits or store other people's information without permission. MyCards is an organisational tool, not a payment service or a retailer account. Check each scanned code and retain the physical card when required.
2. Your data
The publisher does not claim ownership of your card content or sell the stored card names and barcode values. Any rights of the relevant retailers remain unaffected.
Store names and barcode values you enter or scan are stored locally on your device. Core card functions work offline, require no MyCards account and do not use a publisher-operated server to store or synchronise your cards. You remain responsible for the cards you add, checking their accuracy, and your device and backup settings.
Your operating system may include app data in backups according to its settings; these are separate from MyCards and controlled by the relevant provider. Removing cards, clearing app data, uninstalling or a device failure may cause data loss. Deleting local data may not remove backup copies. This local-storage statement concerns card content: website hosting, email support and Google AdMob advertising may process other information as described in the privacy policy.
3. Disclaimer of warranties
To the extent permitted by law, MyCards is provided free of charge, as is and as available. The publisher does not promise uninterrupted or error-free operation, perfect barcode recognition, compatibility with every device or scanner, or acceptance by every retailer. No particular saving, reward or continuing availability of a feature is guaranteed.
You should check saved codes before relying on them and keep an alternative where needed. This disclaimer does not remove warranties, remedies or protections that applicable law makes mandatory.
Retailer names and any logos identify cards without implying endorsement or partnership. Retailers decide whether to accept digital cards and control their own loyalty rules, discounts and rewards. App stores, backup services and linked websites operate under their own terms.
MyCards integrates Google AdMob advertising, which requires an internet connection, while saved cards remain usable offline. Advertising-related technical data and consent are described in the privacy policy. Card names and barcode values are not intended to be supplied to advertisers. The website demo uses fictional cards and simulated scanning; its barcodes are not valid for purchases.
4. Limitation of liability
To the extent permitted by law, the publisher's liability for slight negligence is limited to direct loss reasonably foreseeable when the licence was granted. In that same permitted scope, the publisher is not liable for indirect or consequential loss, lost profit or opportunities, missed loyalty benefits, or loss of data. No compensation is promised merely because a retailer refuses a digital card or a third-party service is unavailable.
All exclusions and limitations of liability in these terms apply to the extent permitted by law.
5. Changes and termination
The publisher may maintain, update or discontinue the app or individual features within the limits of applicable law. There is no promise of indefinite maintenance. Material changes to these terms will be communicated as required; any necessary acceptance will be obtained and new terms will not retroactively remove existing claims. If you do not accept applicable changes, you can stop using the app.
You may end your use at any time by uninstalling. For a material breach of these terms, the publisher may terminate the licence where lawful, giving reasonable notice and an opportunity to remedy the breach when appropriate; immediate termination remains possible for a serious breach that justifies it. On lawful termination, stop using the app and remove your copies, subject to mandatory rights.
MyCards has no user account, and this clause does not imply a remote ability to delete your locally stored cards. You remain responsible for managing local data and operating-system backups. Provisions that by their nature should survive termination, including applicable liability rules and governing law, remain in effect.
6. Applicable law and Swiss jurisdiction
If a dispute arises, we invite you to contact the publisher first to seek an amicable resolution. This is not a requirement that prevents you from bringing proceedings or exercising any mandatory right.
These terms are governed by Swiss law, subject to any mandatory legal provisions that apply. To the extent permitted by law, disputes relating to MyCards or this website fall under the exclusive jurisdiction of the competent courts in Switzerland. Territorial jurisdiction within Switzerland is determined by the applicable procedural rules.
7. Severability
If a provision is invalid or unenforceable, it applies only to the extent lawfully permitted; the remaining provisions continue where allowed by law. This does not turn a prohibited exclusion into an enforceable one.
